Worker Status – When is a Worker an Employee?

Unless the worker is an independent contractor, the answer is always!

There are specific criteria to determine if a worker is an employee or an independent contractor. The key word in that sentence is “independent.”  The most important factor is who is in control.  This is covered in more detail in our March 2010 article Employee or Independent Contractor?

But there are several other issues that can also trip you up.

New 1099 Requirements Coming

To narrow the federal deficit, the IRS plans to add new 1099 reporting requirements, according to a report from the American Institute of Professional Bookkeepers.

These include:

  • Payments to corporations would require a 1099 when they exceed $600 annually.
  • Independent contractors would be subject to withholding if they do not provide a valid TIN—i.e., employers would have to verify TINs.
  • Landlords would have to file 1099s on payments to service providers such as plumbers and carpenters.
